Re: "Escape from Tomorrow" movie filmed in Disneyland secretly

If I was in the background of this film, I would be looking into my options to make sure that I am removed from the film.

I am a union actor. If I am working background, I expect to get paid. I have made myself into a brand and if it was used in a way that I didn't approve of, I'd be pretty upset (so would my agents).

When I'm out and about around LA, I make sure not to go into filming areas. I see those likeness release signs up all the time, and if I'm unsure of where the filming is taking place, I find someone and ask them, or I avoid that area completely.

When I first moved out here, I didn't care too much, and a clip of me was used on one reality show for a couple of years (this was a few years ago and I haven't seen it since).

Maybe someone who isn't pursuing a career in this industry would think it would be cool and fun to be an extra in a movie (even without pay), but for me, I'd think it was someone cheating me out of what I deserve as a professional.

That illustrates the point exactly. Free advertising doesn't always mean that it's going to be the kind of advertising that you want.

Yep. The more videos like that interview are released to the internet, the stronger the legal case against Moore.

I say good for Moore. If I were to meet him I would tell him to keep on keeping on.

Oh, I also find it amusing how this movie offends the delicate sensibilities of most everyone in this thread.

So you find it funny that a fair number of us dislike the fact that this berk broke numerous laws in making a film of a dubious nature without securing the permission of the unpaid extras, location management or the property holders. This man is nothing but a p*** poor publicity hound who is too full of himself to follow the laws and regulations regarding what he did.
The fountain of youth really is in Florida... thats why they built Walt Disney World where they did.

C'mon, folks, admit it - if this had been filmed at Busch Gardens or a Six Flags or Cedar Park location, or some other vacation spot like Hawaii or the Grand Canyon, none of you would be clamoring for this guy's head on a platter. It's only because it was done at Disneyland and WDW that you're all so outraged.

I sure hope from now on, whenever you visit the parks, and you spot someone shooting video from an ordinary camera, that you start hiding your faces like crime suspects on their way to court do. Wouldn't want you to wind up on some monetized YouTube channel or some indie movie, you know.

Re: "Escape from Tomorrow" movie filmed in Disneyland secretly

I don't think people are outraged. I'm certainly not. As someone who has created and managed IP for big media players, I am merely telling you that this movie will very, very likely get shut down.

A C&D will be issued, prohibiting all public exhibition of the work. Concurrently, Disney will be looking at the full suite of civil and criminal options that might apply to this case. Separately, individuals (guests and perhaps even cast members), who did not give express notice for release of their likeness (image and voice), may entertain civil action against the producer(s) of the work.

One thing is absolutely certain - these things are happening right now. There is another thing that is going to make distribution of this film impossible - no legitimate sales rep or distributor will take on any work that has legal or ownership encumbrances of any kind.

I would complain about it no matter where it was filmed. I'm very careful about being filmed in a professional setting. It's different for a video on YouTube. If that went viral and made money, it was not the intention of the person. This was clearly intended for marketing himself and making money. I don't want anyone planning on making money with my image without me being compensated the rate that I should be getting.

No, it's only because it was at Disneyland that we know about it. I know I, and I'm sure most others would feel that what this guy did was just as scummy at any other location.

This is kind of a stretch honestly. I mean, first off, many YouTube channels make money off of these things. If a guy films Mark Twain and I happen to be on it and he make some ad money from it (I'm talking semi-professional youtube channels here) what's the difference?

I get that you're an actor and you should totally be compensated when acting, but in this context you're not acting... you're walking around at Disneyland. Had the shot been filmed 30 seconds earlier or later you wouldn't be in it at all, it'd be the other person walking in front of the castle or whatever. You're about as vital to this film as the people walking in the back of a news segment are... basically, not at all, beyond the fact that you're an ambulatory human.

I think a lot of the arguments here fall flat, really. People are on witness protection and this is the movie that exposes them? Disney parks are basically public places, and tens of thousands of random pictures are taken every day and uploaded to the internet. I get that legally this guy doesn't stand much of a chance, but from an artistic and practical point of view I think this is pretty awesome and that the moral arguments against him are kind of exaggerated.

In general I think this guy did an awesome thing (despite the quality of the actual film) that touches on a lot of conflicts between old and new media. Since we all have tiny, high quality cameras everywhere, why not film a narrative in a theme park? Because you don't want to capture people in the background unwittingly? Okay, so why is the Weekend Update fine when it does the same thing? Because it's not a narrative?

I guess I'd like to question, from a moral point of view, why it's okay for Miceage or any random blogger to take your picture in the Disney Parks but not for another guy who is going to string that picture into a story after the fact.
