I don't think you can say that Indy caused someone to have brain damage. If it did then many of us would have brain damage...well...(avoiding obvious joke).
Anyways the people that have these types of issues plainley have the issues before they ride. Disney should not have to pay for underlying issues that are not directly caused by their attractions.

And why do these vile individuals wait until the que goes into some closed in location before laying down an air mine?

Disney should be required to put Bean-o in their food or face the legal consequences.

(This is all tongue in cheek nonsense. I add this disclaimer in case the mentally impaired may read my post and misunderstand my true intent.)

On a more serious note, the death of that young lady on the Indiana Jones ride was indeed tragic. But as others on this thread have pointed out, it was unavoidable. Perhaps if she had a history of headaches and her doctor had ordered an MRI or CT scan perhaps she would have known not to ride that attraction.

Even so, there are a number of other daily activities which could have triggered the same deadly result: a sudden stop in a car, or even a mild car accident, such as being rear-ended. Or perhaps turning her head sharply to catch the action at a sports event.

The point is we all are going to die. 100% of us will eventually put on the dirt suit. With that in mind, we can take reasonable precautions, but I for one refuse to live in fear. I want to live my life well and not cower in the shadows waiting for the grim reaper to claim me, clinging to the false comfort of a "risk reduced" life. So would it have been better for her to die while in line at the DMV (after abruptly turning her head to see the next available agent) or after riding a thrill ride and having an enjoyable day at Disneyland? We are all going to die anyway so I say live life richly.

Good point. My attitude's always been that if I died on Indy or Screamin' or even Mr. Toad, at least I'll have died doing something I loved.

If DL had a physician on duty at every intense ride, giving physicals and full-body MRI's to every guest, this woman wouldn't have died at the hands of Disney.

Disney has had plenty of cases not only go through court, but to jury verdict. The overwhelming number of cases have been decided in their favor, with a few noteable exceptions.

Many healthy people reported sprains and whiplash-type injuries before the ride was toned down. The warning did not say, "This ride shakes you so hard, you may need to go to the hospital afterwards even if you were healthy when you got on." Instead it had the standard milk-toast warning that Disney also put on the relatively smooth rides like Splash Mountain and the Teacups. Also, in California at least, if a hidden medical problem surfaces as a result of a "dangerous" ride, there is liability. The legal theory is, "you take your victims as you find them" i.e. you can't argue that the egg wouldn't have broken if it was a ping pong ball.

There is kind of a Catch-22 here. If they warned of high risk of injury to healthy people, I don't think California law would allow the continued operation of the ride. At a minimum you would be required to sign a waiver, like sky-diving.

As one of the people who got BRUISES from this ride when it was new (before it was smoothed out), I am probably biased in my thinking that Disney probably saved a pile of money by settling.

It's quite possible that this woman was not aware of any latent medical condition. This is what's been happening with the people who've died on Mission Space. Sometimes these types of conditions can only be diagnosed with advanced stress tests or other kinds of more invasive tests that you simply don't give to someone who shows no symptoms.
