    Goofy's Kitchen lawsuit

    Uh-oh. Well, it won't stop me from dining there on my next visit.

    I've always thought the mandatory gratuity was unusual, especially since that money doesn't seem to be finding it's way to the employees ???

    Disney rarely "loses" lawsuits. Their in-house counsel knows whats up. If the complaint has merit and they can prove it, Disney will settle with them, and if they can't... well, good luck. I know that Disney has shady employment practices, and don't doubt that the allegations are totally possible (if not likely).
    Why do we have to grow up? I know more adults who have the children's approach to life. They're people who don't give a hang what the Joneses do. You see them at Disneyland every time you go there. They are not afraid to be delighted with simple pleasures, and they have a degree of contentment with what life has brought - sometimes it isn't much, either

    Basically Amber Galloway and her attorneys are accusing Disney of requiring employees of Goofy's Kitchen to work through their breaks and not compensating them for such. They are also asking to make this a class action lawsuit by alleging that Disney did this to many employees over the last four years and that Amber should be the named defendant in said suit, the law firm should be the lead attorneys in said suit and that Disney should give Amber, and more importantly her attorney's lots of money to make up for Disney's awful (alleged) behavior.

    when I worked at olive garden they made us work through breaks as well as pay for our entire uniform. 3 years after I quit there was a class action lawsuit and I got a check for almost $700.00. If they are being forced to work through lunch breaks it's easy to prove by pulling the time cards.

    I wonder if free food mitigates things?

    (It doesn't)

    Still, if I knew that, as an employee, I could have free food, as much as I wanted, I might work 6, 7 hours without a break, too.

    Causes of Allegation:
    Cause one: Failure to pay overtime and provide a paid rest break.
    Cause two: Failure to provide paid meal breaks.
    Cause three: Failure to allow rest break
    Cause four: Failure to provide an accurate account of hours worked to Plaintiff and keep such records up to date and available
    Cause five: Waiting time penalties which means that many who have been or quit have not been paid for wages due them.
    Cause six: By withholding these wages, this alleges that Disney has practiced unfair competition against other businesses by getting an equal amount of labor with less wage being paid than those businesses who have followed and kept the labor laws and statutes of the State of CA
    As a result: Relief is requested for the plaintiff(s) in the form of back wages, penalties, etc. ending with Disney ending the practice of alleged practices. They request a jury trial, I saw no mention of a proposed $ amount.

    She appears to be submitting this as a Class Action suit, so that even though she is acting on behalf of a group, I think others may also join in this suit as joint plaintiffs. This class action suit is open to all past and present employees who fit the description and definition of plaintiffs in this Class Action Suit as defined in section IIA paragraphs 8-12.

    I hope that summarized it a bit.

    It is not as simple as it sounds in Mouse child's summary.

    no, California labor law states if an employee is working 6+ hours they get a 30minute lunch. It wold be difficult to prove when i worked at black angus. they of course worked us without breaks as well, but on top of that made us clock out right at 6 hours and continue working until our tables were finished (for free) I only worked there about 5 months and it didn't happen on every shift, but it happened enough. They did offer a limited free food menu, but the restaurant was so dirty I would not even eat the free food there.

    Even my current job is required to give lunch breaks and 10 minute breaks. I have noticed a lunch waiver form we can fill out now, but this is something new.

    so, if they can not prove lunch breaks were given, then that may be bad for Disney.

    It could (perhaps) be shown that not only was that (if proven) a deceptive practice to cover up the alleged forced hours, it would also be in violation of a separate CA law.

    So it might be bad for Disney, then again...

    who knows until it goes before a jury, if it makes it that far.
