Since Disney bought the rights to distribute The Avengers (and Iron Man 3) back from Paramount, part of the agreement was that Paramount would be able leave their banner on the movie though all the financial gains belong to Disney. Paramount was paid $115 million dollars plus a small percentage of the profits because of the huge success. Production credit and bragging rights to a 1.4 billion dollar all belong to Disney as the parent company of Marvel Studios.

This will not be true when Spiderman comes out in about a month. Sony still has the license on the Spiderman character even though he is a Marvel character. Sony pays Marvel (Disney) a licensing fee from a pre-existing contract before Disney purchased Marvel. Same with X-Men and Fantastic Four. Disney CEO Bob Iger was asked if he was interested in buying back some Marvel characters that are licensed to other studios like he did getting Iron Man and The Avengers back from Paramount. He basically said no, we have more than enough characters already.

    Re: Marvel and Paramount

Although the Disney label isn't used with the Avengers, Marvel Studios' logo is shown first before Paramount to reflect that this is a Marvel Studios film distributed by Walt Disney Studios Motion Pictures (the name of what used to be Buena Vista Distribution). In previous Marvel Studios film, Paramount's logo was shown first before Marvel's. Also, the end credits state "Marvel Studios and Paramount Pictures Present...", rather than what happened with previous Marvel Studios films ("Paramount Pictures and Marvel Studios Present...")

Also, Disney owns the existing Marvel Studios films distributed by Paramount, as Marvel Studios self produced them with Paramount as its distributor. Unfortunately, most other films involving Marvel characters, while they involve Marvel, are not owned by Marvel other than the characters in the films (the Spiderman films belong to Sony, although Marvel still owns the character, but doesn't have the film rights to Spiderman as they have been licensed to Sony).

"Distributed by Walt Disney Studios Motion Pictures" Does appear onscreen as the very last title card at the end of the film (after the after credits joke)
