Probably the same way that the not-Disney-made "Donald Duck Orange Juice" came about, and I'm not entirely sure on that one, either. Was Walt really desperate to sell out for a dime at some point or something?
My boyfriend was telling me about this while we were at the Kings/Ducks game this past Friday. I thought it was very interesting! I wondered what the terms of licensing were for the Ducks mascot after the team was sold. I assume that Disney doesn't get a royalty from Oregon's use of Donald?
I played in the Cal Band (University of California Berkeley) from 1986-1990. During that time, we would see the Donald Duck mascot at away games, and he even made one appearance at a basketball game in Berkeley. However, before that basketball game, I remember the Duck getting a little risque in front of the Cal student section. I'm not sure if Disney would appreciate their Duck acting that way.
